Suggested Talking Points:

1. Mr. Charles Burton didn’t kill anyone, didn’t encourage anyone to kill, and did not even see the shooting take place – even according to the State’s conceded version of events.

2. While the shooter was initially sentenced to death, as well, his sentence was later overturned.  The State itself argued that putting Mr. Burton to death, while resentencing the shooter to life without parole, would be “arguably unjust.”  Yet, the State now asks the Alabama Supreme Court to authorize that very injustice!

3. Tori Battle, the daughter of the man killed in the robbery also recently wrote an op-ed asking Ivey to commute Burton’s sentence.

4. There is a lack of scientific evidence supporting the use of nitrogen gas for human execution and the American Veterinary Medical Association advises against its use for most mammals because it can cause panic and distress. We continue to condemn the use of nitrogen hypoxia – it is neither quick nor painless and we believe it constitutes torture or at the least amounts to cruel and unusual punishment which is barred by the U.S. Constitution.

5. Alabama ought to delay all executions to allow for a thorough study of its capital punishment process and consider the serious objections raised as to how it administers the death penalty.
