Execution Alert - Kenneth Eugene Smith - 1.25.24

Alabama has set January 25, 2024 as an execution date for Kenneth Eugene Smith

Please contact Governor Kay Ivey and ask her to stay this execution and remind her of her statement “that all life is sacred!”

The HONORABLE GOVERNOR Kay Ivey
STATE CAPITOL N 104
600 Dexter Ave
MONTGOMERY, AL 36130 2751

Suggested Talking Points:

1. Mr. Smith’s jury voted 11-1 for a life without the possibility parole sentence.
2. Mr. Smith’s rights were violated by the State’s refusal to enter into a good faith plea agreement.
3. On November 17, 2022 the state botched the attempted execution of Kenneth Smith leaving him severely physically scarred and deeply traumatized.
4. Alabama is proposing a nitrogen gas execution and released a heavily redacted protocol. “Deborah Denno, a death penalty expert at Fordham Law School, said that unlike lethal injection and electrocution, which have been used for decades, “experts could only speculate about how a state might conduct a nitrogen hypoxia execution.” She said the filed Alabama protocol does not provide answers because of its vagueness and heavy redactions.”
5. Alabama ought to delay all executions to allow for a thorough study of its capital process to consider the serious objections as to how it administers the death penalty.
