Alabama to move forward with nitrogen gas execution in September after lawsuit settlement It is important to note the statement by Miller’s attorney: “No court upheld the constitutionality of the state’s proposed nitrogen hypoxia method of execution in Mr. Miller’s case, thus the state’s claim that it “successfully defend(ed)” that method’s “constitutionality” is incorrect. By definition, a settlement agreement does not involve a ruling on the merits of the underlying claim.”

Kim Chandler writing for AP: “Grayson has an ongoing lawsuit seeking to block the state from using the same protocol that was used to execute Smith. His attorneys argued the method causes unconstitutional levels of pain and that Smith showed signs of “conscious suffocation.”
The Attorney General has asked the Alabama Supreme Court to authorize setting an execution date for Derrick Dearman who fired his attorney and gave up his appeals. “If Grayson and Dearman are executed this year, their executions would be the fourth and fifth for Alabama in 2024.
According to data from the Alabama Department of Corrections, the last time the state executed more than 3 people in a year was in 2011. That year, under Govs. Bob Riley and Robert Bentley, Alabama put six people to death.”.

Great news regarding our brother Cory Maples! After nearly 30 years and much work by many in and out of state there was a resentencing trial conducted under the rules at that time with the override law. Thankfully the judge followed the jury recommendation for life! Congratulations to all who made this happen.
