Alabama to move forward with nitrogen gas execution in September after lawsuit settlement It is important to note the statement by Miller’s attorney: “No court upheld the constitutionality of the state’s proposed nitrogen hypoxia method of execution in Mr. Miller’s case, thus the state’s claim that it “successfully defend(ed)” that method’s “constitutionality” is incorrect. By definition, a settlement agreement does not involve a ruling on the merits of the underlying claim.”

The attorney general’s office asked the Alabama Supreme to authorize an execution date for Carey Dale Grayson using nitrogen hypoxia.

For a general update about what is happening in this country with the death penalty we quote our partners of Death Penalty Action: “Sure enough, new execution dates have been set in Texas, Florida, Utah (first since 2010) and are being sought in Alabama (another GAS execution), and Indiana (first since 2009). In Louisiana and South Carolina, there's a bloodbath on the way. Any day now we may expect the setting of a slew of execution dates in those states for the first time in over a decade.”
