The Alabama Supreme Court set September 22nd as the execution date for Alan Eugene Miller, a severely mentally disturbed man. Talking Points are posted on our website http://www.phadp.org/?q=alerts. Alan Miller has signed a sworn affidavit stating that he had signed the form opting for nitrogen as his execution method and given it to an officer. A federal lawsuit has been filed by his attorneys which argues that Miller turned in a form selecting nitrogen, but that the state lost it. The attorneys are seeking to block the lethal injection from going forward. “Miller’s team asked the judge to make the state hand over certain pieces of evidence by Friday, so they can review those documents ahead of an evidentiary hearing set for Sept. 12. According to a court filing, Miler’s team argued that the state on Friday made clear it had “begun looking into the how nitrogen hypoxia election forms were collected and stored.” Miller’s attorneys are asking for documents and communications regarding how the state solicited, collected, and stored death row inmates’ nitrogen hypoxia elections. They’re also asking for information related specifically to Miller’s form and steps the state is taking to look for it.” We remember how it all went down. The question is will the State admit that the process was bungled?

We are encouraged that a group of activist in Alabama is not willing to forget about Joe James’ botched execution or the horror of executions in general. We will have more details on this as it all comes together.

We would like to thank Dr. Philip Hansten for gifting us with his new book Death Penalty Bullshit which those of us who have read it really appreciate. It is making the rounds at Holman. One man called it “a good weapon in the arsenal” and although the arguments presented are not new to those of us involved with the death penalty, we really like the straight forward, honest approach which those in favor of killing sorely lack, preferring instead to hide behind platitudes and lies.
